Terms of Use

Welcome to FAK.

These Terms of Use govern access to and use of the FAK application.

A user must accept these Terms before using FAK. The Privacy Policy explains how personal information is handled and must also be acknowledged where required by the app.


Eligibility

A user must have the legal capacity to accept these Terms and must meet any minimum age or parental-consent requirement that applies where the user lives.


What FAK Does

FAK is a personal budgeting and financial-tracking app. It provides tools to help users plan budgets, record income and spending, understand spending habits and track their financial activity.

FAK does not connect to bank accounts, access banking credentials, hold, move or transfer money, process payments itself, or provide lending, insurance, credit or investment services.


Important Financial Disclaimer

FAK is a budgeting and financial-tracking tool only.

FAK does not provide financial, investment or tax advice and is not a professional accounting or bookkeeping service.

FAK does not guarantee savings, financial improvement or any particular financial outcome.

The accuracy and usefulness of FAK depend on the information entered by the user. FAK does not independently verify whether information entered by a user is accurate, complete or current. Missing, inaccurate or outdated information may result in inaccurate budgets, calculations, estimates, reports or other information displayed by the app.

Calculations may use averaging, rounding and whole-number values to provide practical budgeting guidance. Information shown in FAK may therefore differ from bank statements, tax records, accounting records or other financial records.

Users remain responsible for their own financial decisions and use FAK at their own discretion. FAK should not be relied on as the sole source of information required for legal, tax, accounting, financial or other professional purposes.

To the fullest extent permitted by applicable law, FAK is not responsible for financial loss arising from reliance on information, budgets, calculations, estimates or reports provided by the app, including loss resulting from inaccurate or incomplete user input, missed entries, budgeting assumptions or financial decisions made using FAK.

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.


Free Service

FAK currently offers a Free tier.

The continued existence of the Free tier and the continued availability or scope of any Free feature are not guaranteed.

FAK may change, limit or remove Free functionality, discontinue the Free tier, move Free features to Paid Subscription Plans, or make functionality that is currently free subject to payment in the future, subject to applicable law and app-store requirements.

Changing a feature from Free to paid does not automatically enrol a user in a subscription or authorise a charge. A paid subscription still requires the applicable purchase or consent process through the relevant app store.


30-Day Pro Trial

Each eligible new FAK account receives 30 days of Pro access beginning when the Trial is issued.

No payment details or paid app-store subscription are required to begin the Trial. Starting the Trial does not automatically enrol a user in a paid subscription or authorise a charge.

Users may purchase a Paid Subscription Plan at any time during the Trial. If a user subscribes, billing begins when the app-store subscription starts. Any remaining Trial time does not postpone paid billing.

Once a paid subscription has been established, the normal paid-subscription lifecycle described in these Terms applies. The previous Trial does not restart or replace that lifecycle.

If a user does not subscribe, Pro Trial access ends automatically after 30 days. There is no Trial grace or recovery period.

When the Trial ends without a subscription, active Pro-only budgets expire and become permanently read-only. Their available reports and history remain accessible where supported, but subscribing later does not automatically reactivate those expired budgets. Users may continue using FAK with the Free Spend Tracker.


Paid Subscription Plans

FAK may offer optional Paid Subscription Plans that provide access to additional features, including paid budget templates and other paid functionality.

New users must create and use a FAK account to access FAK. Paid Subscription Plans remain optional and require a separate purchase through the applicable app store.

Available subscription periods, products and prices may change over time. The plans currently available to a user are those presented through FAK and the applicable app store at the time of purchase.

The authoritative price and currency are the localised price and currency displayed by the Apple App Store or Google Play when the subscription is purchased. Prices may differ depending on storefront, region, taxes and other applicable store requirements.

Payments are processed by the applicable app store. FAK does not receive raw payment-card details.


Billing, Renewal and Cancellation

Paid Subscription Plans may renew automatically according to the subscription period and conditions displayed by the applicable app store when the subscription is purchased.

Users are responsible for managing and cancelling their Paid Subscription Plan through the app store where it was purchased.

Cancellation generally prevents future renewal rather than ending an already-paid subscription period immediately. Paid subscription access normally continues until the end of the current billing period.

If a paid subscription is renewed before it expires, paid access continues and the user’s paid budgets remain active.

Refunds, billing disputes, subscription price changes and related payment matters are handled according to the rules of the applicable app store, applicable law and mandatory consumer rights.


Subscription Access and Account Association

Paid subscription access is associated with the relevant FAK account and verified through the applicable app store and subscription infrastructure.

Verified paid access may be recognised across supported devices or platforms when the same owning FAK account is used.

An active store subscription cannot be silently transferred between unrelated FAK accounts.

Where a subscription or account conflict occurs, the user may be required to sign in to the FAK account associated with the subscription or contact FAK for assistance.


Subscription Payment Problems and Expiry

If a subscription payment fails or a store reports another recoverable billing problem, FAK may temporarily continue, restrict or suspend paid access while the subscription remains recoverable.

The availability and duration of any grace or recovery period may depend on the applicable store, subscription state and FAK's implemented subscription-protection policy.

During a recovery period, some paid features or paid budgets may become temporarily unavailable or read-only while existing information remains available where reasonably possible.

If a payment or billing problem is not resolved within any applicable grace or recovery period, the paid subscription may end. When a paid subscription ends for this or any other reason, paid budgets are kept but become permanently read-only and cannot be reactivated, even if the user purchases a paid subscription again in the future. Users can still access their reports history and continue using FAK with a Free budget.

Changing a device's date or time does not create or extend valid paid subscription access.


Complimentary Paid Access

The standard 30-day Pro Trial described in these Terms is separate from any discretionary promotional or complimentary access provided under this section.

FAK may provide promotional or complimentary access to paid features at its discretion.

Complimentary access is separate from a paid app-store subscription and does not itself create recurring billing.

Such access may be subject to separate conditions communicated when it is provided and may be changed, withdrawn or discontinued where legally permitted.


Accounts and Security

A FAK account is associated with one registered email address and is intended for use by the account owner.

A FAK account may not be sold, assigned or transferred to another person.

Changing the registered email address does not transfer ownership of the account to another person.

FAK does not guarantee that the email address associated with an account can be changed.

In exceptional circumstances, a user may contact FAK support to request a change to the registered email address. Any such request is subject to account-ownership verification. FAK may refuse a request where ownership cannot be established to a reasonable standard or where the requested change would create a security, legal or account-integrity concern.

A requested email-address change is not guaranteed to be possible or successful.

Users are responsible for taking reasonable steps to protect passwords, authenticator access, 2Factor Authentication recovery information and devices used to access FAK.

Suspected account compromise should be addressed promptly and reported to FAK where assistance is required.

Reasonable safeguards are used to protect the service, but no software or internet service can be guaranteed to be completely secure.


Cloud Backup and Account Restore

Applicable signed-in account data may be backed up to FAK's backend infrastructure as account-owned cloud backup data.

Account Restore can restore a compatible account backup to a device.

Backup and restoration depend on account access, authentication, connectivity, compatibility and service availability. Backup and restoration are not guaranteed to be instantaneous, uninterrupted or permanently available.

FAK does not provide or guarantee conflict-free real-time synchronisation between multiple devices.

Information stored only on a device may be lost if that device is lost, replaced, reset or damaged.

Users should not rely on FAK as the sole recordkeeping system where information must be retained for legal, financial, tax, accounting or professional purposes.


Account Deletion

A user may request permanent deletion of a FAK account through the available account-deletion process.

Account deletion removes applicable FAK account and cloud data according to the implemented deletion policy, subject to information that must be retained for legal or security reasons.

Deleting a FAK account does not automatically cancel an Apple App Store or Google Play subscription and does not control the user's independent billing relationship with Apple or Google.

To prevent future renewals or charges, users are responsible for separately cancelling any applicable subscription through the app store where it was purchased.


Service Availability and Changes

FAK may update, change, limit, suspend or discontinue features or services and may, where necessary, discontinue FAK as a service entirely. This may occur for technical, security, legal, commercial, operational or other reasonable business reasons.

Where reasonably possible, appropriate advance notice will be provided before FAK is permanently discontinued. Any active Paid Subscription Plans will remain subject to applicable app-store rules, refund requirements and mandatory consumer rights.

FAK may also temporarily interrupt the service for maintenance, security, technical, legal or operational reasons.

Uninterrupted service, permanent feature availability and perfect data availability are not guaranteed.

Nothing in these Terms limits rights that cannot be excluded under applicable law.


Third-Party Stores and Services

FAK relies on third-party services for functions including app distribution, billing, authentication, cloud backup, subscription management and analytics.

The availability, operation and terms of those third-party services may affect the availability or operation of FAK.

FAK is not responsible for the independent operation of third-party services beyond what can lawfully be required under applicable law.


Acceptable Use

Users must not:

  • Use FAK for unlawful, fraudulent or abusive purposes.
  • Attempt to interfere with, disrupt, damage or compromise the security or operation of FAK or its supporting services.
  • Attempt to gain unauthorised access to accounts, systems, data or services.
  • Misuse account, subscription, backup, support or other FAK functionality.
  • Reverse engineer FAK except where applicable law permits it.

Account Suspension and Termination

FAK may restrict, suspend or terminate access to an account or to some or all FAK services where there is a reasonable basis to believe that:

  • The account or service is being abused or misused.
  • FAK is being used unlawfully or fraudulently.
  • The user has materially breached these Terms.
  • The account is being used to interfere with or compromise the security, integrity or operation of FAK or another account.
  • Restriction or suspension is reasonably necessary to protect users, FAK, its service providers or the service.
  • Restriction is required by law or another applicable legal obligation.

FAK may take reasonable action based on the nature and seriousness of the issue, including temporary restriction, suspension or permanent termination where appropriate.

Where reasonably possible and legally appropriate, notice may be provided. Immediate action may be taken where necessary to address security, fraud, abuse, legal or service-integrity risks.

Nothing in this section limits any rights that cannot lawfully be excluded.


Intellectual Property

The FAK application, branding, logos, graphics, software and supplied content remain the property of FAK or the applicable rights holder.

Using FAK does not transfer ownership of those materials or grant a right to copy, modify, distribute or commercially exploit them except where applicable law permits it.


Limitation of Liability

FAK is intended to assist with personal budgeting and financial tracking. Users remain responsible for deciding how to use the information provided by the app and for their own financial decisions.

To the fullest extent permitted by applicable law, FAK is not liable for direct, indirect, incidental, consequential or other financial loss arising from or connected with:

  • Inaccurate, incomplete, outdated or incorrectly entered user information.
  • Missed or incorrectly recorded income, spending or other entries.
  • Budgeting calculations, estimates, averages, projections or reports.
  • Decisions made in reliance on information displayed by FAK.
  • Loss of locally stored information where an independent record or backup was not maintained.
  • Temporary or permanent service interruption.
  • Failure or unavailability of third-party stores, infrastructure or services.
  • Inability to access, restore or synchronise information where this results from circumstances outside FAK's reasonable control.

Users should maintain independent records where information is important for legal, tax, accounting, financial or professional purposes.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence where it cannot lawfully be excluded, or any other liability or consumer right that cannot legally be excluded or limited.


Changes to These Terms and Re-consent

FAK may update these Terms from time to time.

The version number and Last updated date identify the current document.

Where appropriate, including when a material change is made, FAK may require a user to accept the updated Terms before continuing to use FAK.


Governing Law and Consumer Rights

These Terms are governed by the laws applicable to FAK as a service operated from Portugal.

Nothing in these Terms removes any mandatory consumer protection, legal right or forum available under applicable law, including mandatory rights that may apply in the country where the user lives.
